HB 422 Model Ordinance Update

HB 422 MODEL ORDINANCE UPDATE:
(November 2016)

Both model ordinances have been updated to correct an error in Section 2.  Previous versions of the ordinances stated that members must be residents for one year prior to creation of the board.  The updated ordinances now track the statutory requirement that members must be residents for one year prior to their appointment. 

SECTION 2.  Creation and membership. 
There is hereby created pursuant to KRS 65.8801 to KRS 65.8839 within the city, a code enforcement board which shall be composed of [no fewer than three] members, all of whom shall be residents of the city for a period of at least one (1) year prior to their appointment and shall reside there throughout the term in office.

HB 422, passed in the 2016 legislative session, substantially reforms the Local Code Enforcement Board Act.  Any city that currently has or is considering a code enforcement board will need to review the requirements and be prepared to update its ordinances.  KLC has created two model ordinances based on HB 422. 

Model A is for cities that have a code enforcement board but do not utilize hearing officers.
