Provisional Policy Available from DLG

In compliance with the provisions of House Bill 5 from the 2014 legislative session, the Department for Local Government has produced a "provisional policy" to provide guidance to local governments to minimize the risk of disclosing personal information and setting practical guidelines for effectively responding to security incidents. This provisional policy is effective beginning January 1, 2015.

A formal regulation will be promulgated around the conclusion of the 2015 legislative session.  This provisional policy will provide an opportunity for city officials to offer feedback before the formal policy is started in the regulatory process. 

Kentucky cities do not need to adopt the policy by ordinance; instead of publishing an ordinance, cities may adopt the provisional policy through an executive or municipal order. Go here to access the provisional policy from DLG.
